BYLAWS
GENERAL PROVISIONS
The Bylaw Committee chaired by President Christopher Poole, consisting of Business Manager Tony Castrello; Business Representative Rick Simone; and, the Excutive Board of Local 58. have moved that Local 58 be governed by the rules setforth in the Constitution and Ritual of the Sheet Metal Workers International Association and the merger agreement between Local Union 58 and Local Union 527,dated July 1, 2004

The following are part of the merger agreement
Committees
7. The Negotiating Committee shall consist of the following: Business Manager/Financial Secretary/Treasurer, Business Representaive for Production/Residential, Chief Stewards.
8. The tellers and judge(election committee) shall make arrangements for and conduct elections at times and places specified by the local union in accordance with the Constitution; examine and count all legal ballots cast; prepare a written report of all ballots cast for each candidate and the number of void ballots: sign said report in the presence of each other and submit the same to the recording secretary.
Stewards
9. It shall be the duty of the chief stewards to assist union members and their respective backup stewards in the investigation, preparation and processing of grievances.
10. Chief stewards and backup stewards shall be appointed as per the Constitution by the Business Manager following a "straw vote" for a period of up to three ( 3 ) years, although it's not necessarily to coincide with the election of the Union officers; and, shall serve at the pleasure of the Business Manager. Permanent vacancies shall be filled by appointment by the Business Manager.
11. "Straw Votes" of chief/backup Stewards will be conducted per the Constitution but do not require the use of voting machines.
12. On all Stewards "Straw Votes" the ballots will be counted in the area where the voting was held and in the presence of the candidate(s) if they so desire.
Duties of Officers
13. It shall be the duty of the Business Representative for Production/Residential to post all notices on the Union bulletin Boards.

15. All full time officers, stewards, backup stewards, specialists and members shall receive vacation pay based on time missed from work, which is compensated by the Union in accordance with Article XXIV of the current contract / collective bargaining agreement.
16. Any local Union Representative who misses more than three (3) consecutive regular quarterly meetings, without an approved excuse, shall be automatically removed from office. (Approved excuses: vacation, leave of absence, bereavement or working during scheduled meeting time.)
18. A regular quarterly meeting will not be conducted without a quorum present. A quorum shall consist of not less than twenty-five (25) members in good standing.
19. All letters of agreement pertaining to our contract must be ratified by the membership at a regular monthly meeting.
21. The Executive Board, per the Constitution (Article 12, section 9) shall have authority to pay such salaries as it may determine for services rendered by the local union officers, Business Manager, Business Representatives, delegates, Representatives and members.
22. The Executive Board shall have the authority to pay such salaries and benefits as it may determine for services rendered by local union office staff.
